Welcome to the Iowa Demon Hawks Platform/App!

These Terms of Use (or "Terms") govern your use of the Iowa Demon Hawks Platform/App, except when we explicitly state that other terms (not these) apply, and provide information about the Iowa Demon Hawks Service (the "Service"), described below. By using or creating an account on the Iowa Demon Hawks Platform/App, you agree to these terms.

The Iowa Demon Hawks Service is provided to you by Iowa Demon Hawks. These Terms of Use, therefore, constitute an agreement between you and Iowa Demon Hawks.

The Iowa Demon Hawks Service

We agree to provide you with the Iowa Demon Hawks Service. The Service includes all products, features, apps, services, technologies, and software provided to promote the mission of Iowa Demon Hawks: strengthening relationships between community members and enhancing workout and service experiences.

Your Commitments

In exchange for our commitment to providing the Service, we require that you commit to the following:

Who Can Use the Iowa Demon Hawks Platform/App

  • You must be at least 13 years old or the minimum legal age in your country to use the Iowa Demon Hawks Platform/App.
  • You must not be prohibited from receiving any aspect of our Service under applicable laws.
  • Your account must not have been previously disabled by us due to violations of the law or any of our policies.
  • You must not have been convicted of a sexual offense.

How You Cannot Use the Iowa Demon Hawks Platform/App

  • You must not impersonate others or provide inaccurate information.
  • You must not engage in unlawful, deceptive, fraudulent, or unauthorized activities.
  • You must not violate these Terms or our policies, including the Privacy Policy.
  • You must not interfere with or disrupt the intended operation of the Service.
  • You must not sell, license, or purchase accounts or data from us or our Service.
  • You must not post private or confidential information of others without permission.
  • You must not modify, translate, create derivative works, or reverse engineer our products.
  • You must not use a domain name or URL in your username without our prior written consent.

Permissions You Grant Us

As part of our agreement, you grant us certain permissions necessary to provide the Service.

License to Use Your Content

We do not claim ownership of your content, but you grant us a license to use it. This license allows us to host, use, distribute, modify, display, and perform your content in connection with providing the Service. This license will end when your content is deleted from our systems.

Use of Your Username, Profile Picture, and Interactions

You grant us permission to show your username, profile picture, and interactions (such as likes) alongside sponsored content without compensation. For example, we may show that you liked a sponsored post from a brand that paid us to display their ads.

Updates to the Service

You agree that we may download and install updates to the Service on your device as needed.

How Our Service is Funded

Instead of paying for the use of the Iowa Demon Hawks Platform/App, by using the Service provided in these Terms, you acknowledge that we may show you advertisements that companies and organizations pay us to promote inside and outside the Iowa Demon Hawks Platform/App. We use your personal data, such as activity and interest information, to display ads that are more relevant to you.

We display useful and relevant ads without advertisers knowing who you are. We do not sell your personal data. We allow advertisers to inform us, for example, of their business goals and the type of audience they want to reach with the ad. Then, we show the ad to people who may be interested.

We also provide advertisers with reports on ad performance to help them understand how people are interacting with content inside and outside the Iowa Demon Hawks Platform/App. For example, we provide demographic data and general interest information to advertisers to help them better understand their audience. We do not share information that directly identifies you (such as your name or email address, which someone could use to contact you or verify your identity).

You may see branded content on the Iowa Demon Hawks Platform/App published by account owners who promote products or services based on a commercial relationship with the business partner mentioned in such content.

Privacy Policy

Providing our Service requires collecting and using your information. The Privacy Policy explains how we collect, use, and share information on the Iowa Demon Hawks Platform/App. It also explains the various ways you can control your information. You must agree to the Privacy Policy to use the Iowa Demon Hawks Platform/App.

Your Commitments

In exchange for our commitment to providing the Service, we require you to agree to the following.

Who Can Use the Iowa Demon Hawks Platform/App

We want our Service to be as open and inclusive as possible, but we also want it to be safe and compliant with the law. Therefore, we need you to commit to some restrictions to be part of the Iowa Demon Hawks Platform/App community.

  • You must be at least 13 years old or the minimum legal age in your country to use the Iowa Demon Hawks Platform/App.
  • You must not be prohibited from receiving any aspect of our Service under applicable law or engaging in payments related to the Service if your name appears on a restricted party list.
  • Your account must not have been disabled by us due to a violation of the law or any of our policies.
  • You must not have been convicted of a sexual offense.

How You Cannot Use the Iowa Demon Hawks Platform/App

Providing an open and safe Service for a broad community requires all of us to do our part.

  • You may not impersonate others or provide inaccurate information. You must provide us with accurate and up-to-date information (including registration information), which may include personal data. Additionally, you may not impersonate someone or something you are not, and you may not create an account for someone else without their express permission.
  • You may not engage in anything unlawful, misleading, fraudulent, or for an illegal or unauthorized purpose.
  • You may not violate (or help or encourage others to violate) these Terms or our policies, including, in particular, the Privacy Policy.
  • You may not interfere with or affect the intended operation of the Service. This includes misuse of any reporting, dispute, or appeal channel. For example, making fraudulent or baseless reports or appeals.
  • You may not interfere with or affect the intended operation of the Service. This includes creating accounts or collecting information in an automated way without our express permission.
  • You may not sell, license, or purchase any account or data obtained from us or our Service. This includes attempting to buy, sell, or transfer any element of your account (including your username), requesting, collecting, or using login credentials or badges of other users, requesting or collecting usernames and passwords from the Iowa Demon Hawks Platform/App, or misappropriating access codes and tokens.
  • You may not post private or confidential information of others without permission or do anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement, counterfeit goods, or pirated items). You may use content created by others according to copyright exceptions and limitations under applicable law. You declare that you own or have obtained all necessary rights for the content you publish or share.
  • You may not modify, translate, create derivative works, or reverse engineer our products or their components.
  • You may not use a domain name or URL in your username without our prior written consent.

Permissions You Grant Us

As part of our agreement, you also grant us the necessary permissions to provide the Service.

We do not claim ownership of your content, but you grant us a license to use it.

Nothing changes regarding your rights over your content. We do not claim ownership of your content that you post on or through the Service. Additionally, you are free to share your content with anyone else, wherever you want. However, we require you to grant us certain legal permissions (known as a “license”) to provide the Service.

When you share, post, or upload content protected by intellectual property rights (such as photos or videos) on our Service or in connection with it, you grant us a non-exclusive, royalty-free, transferable, sublicensable, and worldwide license to host, use, distribute, modify, run, copy, publicly display or perform, translate, and create derivative works of your content (consistent with your privacy and app settings). This license will end when your content is deleted from our systems. To remove content individually or all at once, simply delete your account.

Permission to use your username, profile picture, and information about your relationships and actions with accounts, ads, and sponsored content.

You grant us permission to display your username, profile picture, and information about your actions (such as likes) or relationships (such as accounts you follow) alongside or related to accounts, ads, offers, and other sponsored content that you follow or interact with, which are displayed in the Iowa Demon Hawks Platform/App products, without paying any compensation to you.

For example, we may show that you liked a sponsored post created by a brand that paid us to display its ads on the Iowa Demon Hawks Platform/App. Just like taking actions on other content and following other accounts, taking actions on sponsored content and following sponsored accounts are acts that can only be seen by people who have permission to see or follow such content.

You agree that we may download and install updates to the Service on your device.

Additional Rights We Retain:

If you select a username or a similar identifier for your account, we may change it if we believe it is appropriate or necessary (for example, if it violates another person's intellectual property or impersonates another user).

If you use intellectual property rights-protected content that we own and make available on our Service (such as images, designs, videos, or sounds that we provide and you add to the content you create or share), we will retain all rights to our content (but not to yours).

You may only use our intellectual property, our trademarks, or similar marks with our prior written permission.

You must obtain our written permission or an open-source license to modify, create derivative works, decompile, or otherwise attempt to extract our source code.

Content Removal and Account Deactivation or Termination:

We may remove any content or information you share on the Service if we believe that content violates these Terms of Use or our policies, or if we are authorized or required by law to do so. We may refuse to provide or immediately stop providing all or part of the Service to you (including terminating or deactivating your access to Iowa Demon Hawks' Platform/Mobile App products) to protect our services or our community, or if you create risk or legal exposure for us, violate these Terms of Use or our policies, repeatedly infringe on others' intellectual property rights, or when we are legally permitted or obligated to do so. We may also terminate or modify the Service, remove or block content or information shared on the Service, or stop providing all or part of the Service if we determine that it is reasonably necessary to prevent or mitigate adverse legal or regulatory impacts on us.

If you believe your account was terminated by mistake or if you want to deactivate or permanently delete it, please visit our Help and Support Center.

When you request the deletion of content you have posted or your account, the process will begin automatically within up to 30 days after your request. The deletion of the content may take up to 30 days after the deletion process begins. Although the deletion process for certain content has already begun, the content will no longer be visible to other users but will remain subject to these Terms of Use and our Privacy Policy. After the content has been deleted, it may take up to an additional 30 days to remove it from our backup and disaster recovery systems.

Content will not be deleted within 30 days after the deletion process begins in the following circumstances:

  • If your content has been used by others in accordance with this license and they have not deleted it (in this case, the license will continue to apply until that content is deleted); or
  • If deletion cannot occur within 30 days due to technical limitations of our systems. In this case, we will complete the deletion as soon as it is technically possible; or
  • If deletion would restrict our ability to:
    • Investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of products or systems);
    • Ensure the protection of our products, systems, and users;
    • Comply with a legal obligation, such as preserving evidence; or
    • Respond to a request from a judicial or administrative authority, law enforcement, or a government agency.

In this case, the content will be retained only for as long as necessary for the purposes for which it was retained (the exact duration will vary on a case-by-case basis).

If you delete your account or we deactivate it, these Terms will dissolve the agreement between you and us. However, this section and the section below titled "Our Agreement and What Happens If We Disagree" will still apply even after the termination, deactivation, or deletion of your account.

Our Agreement and What Happens If We Disagree:

If any aspect of this agreement is unenforceable, the remaining aspects will remain in effect.

Any amendments or waivers related to this agreement must be made in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be considered a waiver.

We reserve all rights not expressly granted to you.

Who Has Rights Under This Agreement:

This agreement does not grant rights to any third parties.

You may not transfer your rights or obligations under this agreement without our consent.

Our rights and obligations may be assigned to others. For example, this could occur in the event of a change of ownership (such as a merger, acquisition, or sale of assets) or in accordance with the law.

Who is responsible if something happens:

Our Service is provided "as is," and we cannot guarantee that it will be safe and work perfectly all the time. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We also do not control what people or third parties do or mention and are not responsible for their (including yours) conduct or actions, online or offline, nor for content (including objectionable or illegal content). We are also not responsible for services and features offered by other people or companies, even if you access them through our Service.

Our liability for any occurrence in the Service will be limited as permitted by law. We cannot predict all possible impacts a problem with our Service may cause. You agree that we will not be responsible for any loss of profit, revenue, information, or data, or for incidental, special, indirect, exemplary, punitive, or consequential damages arising out of or related to these Terms, even if we are aware of their possibility. This applies even if we delete your content, information, or account.

How we handle disputes:

If you are a consumer, the laws of the country in which you reside will apply to any claim, cause of action, or dispute you have against us arising out of or relating to these Terms (“claim”), and you may resolve your claim in any competent court in such country with jurisdiction. In all other cases, you agree that the claim must be resolved exclusively in the Court of the District of Petrópolis – RJ, and you submit to the personal jurisdiction of this Court to resolve the claim, regardless of conflict-of-law provisions. Notwithstanding the foregoing, you agree that, at the sole discretion of Iowa Demon Hawks, we may also bring claims against you related to attempts of abuse, interference, or unauthorized use of our products in any competent court in your country of residence with jurisdiction for such matters.

Unsolicited Material:

Your feedback and other suggestions are always welcome, but we may use them without any restriction or obligation to compensate you for them, and we have no duty to maintain their confidentiality.

Updating these Terms:

We may change our Service and policies, and we may need to update these Terms to accurately reflect our Service and policies. Unless otherwise required by law, you will be notified (for example, through our Service) before we modify these Terms and will have the opportunity to review them before they take effect. Therefore, if you continue using the Service, you will be bound by the updated Terms. If you do not agree with these or any updated Terms, you may delete your account within the App.
